How we helped a Newport woman recover compensation after a bus accident
Mrs H, who is in her 70s, was on a bus traveling to the shops in Newport. A car driving erratically cut the bus up. The bus driver had no choice but to slam on the brakes to avoid a collision. As a result Mr H was thrown forwards into the windscreen and knocked unconscious in thee bus accident.
When she came to, she was extremely shocked and distressed, as well as being in considerable pain. She was taken to the Royal Gwent Hospital and checked over. X-rays showed that she had fractured a rib. She also had extensive bruising and cuts to her hand.
Mrs H got in touch with us to see if we could assist her in making an compensation claim for the bus accident.
We considered how the accident had happened and agreed to deal with her claim on a No Win – No Fee basis.
The first hurdle was to trace the driver of the car that had caused the accident. Obviously Mrs H had been unable to note down any details at the time. We therefore got in touch with the bus company who had captured the incident on their bus CCTV. This meant we were able to locate the car driver and his insurers.
We notified the insurers of the claim and the injuries suffered by Mrs H.
The insurers admitted liability for the accident on behalf of the car driver, so it was then a question of assessing the extent of the injuries and reaching agreement on an appropriate level of compensation.
We arranged for Mrs H to be examined by an independent Consultant Orthopaedic Surgeon who prepared a report about the injuries she had suffered.
Mrs H had also suffered distressing psychological symptoms following the accident. She was troubled by memories of the accident and felt anxious when going out or using a bus. Her injuries and subsequent limitations had affected her mood and made her feel low. We therefore arranged for her to be assessed by an independent Clinical Psychologist who was able to give useful advice and recommendations to get Mrs H back to feeling her old self.
We gathered information and evidence about the financial impact of the accident and the expenses that Mrs H had incurred as a result of the accident.
After a period of negotiation with the insurance company we were able to agree a compensation settlement that Mrs H was very happy with.
